These Terms of Service ("Terms") govern your access to and use of our technology marketplace platform, websites, mobile applications (Karyak for Customers and Karyak Pro for Workers), and related services (collectively, the "Platform") operated by Karyak Technologies Private Limited ("Karyak", "we", "us", or "our").
By registering for an account or using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
1. Platform Service Description
Karyak is a technology marketplace Platform that connects customer clients ("Customers") seeking local services with independent skilled professionals ("Workers" or "Pros") offering those services.
- Independent Contractor Status: Pros are independent contractors and are not employees, agents, joint venturers, or partners of Karyak. Karyak does not perform services, nor does it control or direct the Pros' work, scheduling, quality, or methods.
- Direct Agreement: When a Customer accepts a Pro's offer or bookings are matched, they enter into a direct agreement with each other. Karyak is not a party to any contract or transaction executed between Customers and Pros.
2. WhatsApp OTP Registration & Access
To use the Platform, you must register an account using your mobile phone number.
- Authentication: Accounts are verified and accessed via a One-Time Password (OTP) delivered securely through WhatsApp. You are solely responsible for maintaining the privacy and security of your active WhatsApp number.
- Accuracy: You agree to provide accurate, current, and complete registration details and update them immediately in the event of any changes.
3. Aadhaar KYC and Verification
To maintain safety, integrity, and trust within our community:
- Mandatory Verification: All Pros on Karyak Pro must undergo Aadhaar-based Know Your Customer (KYC) database validation to receive a "Verified" badge.
- Accurate representation: Any attempt to use falsified, synthetic, or third-party identification details will result in immediate and permanent account suspension and potential reporting to local law enforcement.
- Limitations: While Karyak conducts KYC verification to verify identities, Customers are still encouraged to exercise standard safety precautions when letting Pros into their homes.
4. Payment Escrow & Fees
All financial transactions on the Platform are processed through secure integration partners (e.g., Razorpay / UPI gateways):
- Upfront Escrow: When a Customer books a service, the estimated job charge plus a platform processing fee is paid upfront and held in a secure trust escrow wallet.
- Release of Funds: The escrowed funds are held until the Pro uploads completion proof and the Customer clicks "Approve Work". This automatically triggers the release of the payout to the Pro's registered banking/UPI coordinates.
- Platform Cut: Karyak charges a 10% platform fee from the Pro's gross earnings on completed orders. There are no upfront fees to list services.
5. Cancellation and Visit Fee Policies
To ensure mutual reliability and reduce ghosting, we enforce strict cancellation thresholds:
- Worker Cancellation: If a Pro cancels an accepted job request within 1 hour of the scheduled time, it is flagged as a late cancellation. This impacts search rankings and can lead to temporary account lockout.
- Customer Cancellation: If a Customer cancels a job request after the Pro is en route, a pre-calculated "visit fee" is charged to compensate the Pro for travel time and resources.
6. Disputes & Arbitration
In the event of a dispute regarding work quality, pricing mismatches, or locked escrow funds:
- Dispute Flag: Either party can flag the booking as "Disputed", which pauses the release of escrow funds.
- Admin Intervention: Both parties must submit photo or video evidence of the work. A Karyak administrator will review the evidence and arbitrate the dispute within 24 hours. The administrator's decision regarding the distribution of escrow funds is final and binding on both parties.
7. Limitation of Liability
Karyak Technologies Private Limited acts solely as a platform provider. We are not liable for any claims, demands, damages, losses, or disputes arising out of the conduct of Customers or Pros, including but not limited to bodily injury, property damage, or theft occurring during the performance of services.
